- How to entrer
No purchase is necessary. Competition opens 23 February and closes 16 April, 2010 at midnight.
To enter the Championship Moves competition individuals must create an original “Championship Move” that will be filmed by a Championship Moves representative at the festival, or individually uploaded to the Championship Moves website.
All entries that are incomplete, indecipherable, illegible, damaged, irregular, contain illicit content, or do not conform to or satisfy any condition of these Terms and Conditions may be disqualified. The Promoter is not responsible for any lost, illegible, incomplete, misdirected, damaged or destroyed entries. - Eligibility
Information on how to enter and prizes forms part of these Terms and Conditions. Entry is open to residents of Australia who are 18 years of age or over. Employees, officers, directors (including immediate family members and members of the same household) of the Promoter and Sponsors and their respective affiliated and advertising agencies and any other organisations associated with this Contest are not eligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Terms and Conditions. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to moderate, disallow, remove or disqualify any entries which are deemed to be unwarranted, racially offensive, religiously insensitive, employ negative behaviour, illegal acts or that demonstrate defamatory behaviour. Entrants, by entering this contest, agree to abide by these Terms and Conditions, and that the decisions of the Promoter are final. No correspondence will be entered into. When an entrant submits any materials via the Promotion including comments, recordings and images (“Content”), the entrant, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights. Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; and (c) they will comply with all applicable laws and regulations, including without limitation, those governing content, defamation, privacy and publicity. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms. All entries submitted become the property of the Promoter. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
- Prizes
The entry which receives the highest number of votes on the official Championship Moves website, as determined by the Promoter in its absolute discretion, will receive six entry tickets to the Groovin in the Moo music festival which will take place at the Bendigo Showgrounds on 1 May, 2010. The Promoter will select additional reserve entries which will be the next most popular by the voting mechanism of the official Championship Moves website, and record them in order, in case of an invalid entry or ineligible entrant. The Promoter reserves the right to substitute the Prize(s) in whole or in part in the event that any component of the Prize is unavailable. Prizes are not otherwise transferable, deferrable, exchangeable or redeemable for product and cannot be taken in cash. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
- Winning
The Contest is a game of skill and chance plays no part in determining the winners. The winning entries will be determined by the number of votes received within the official Championship Moves website only and utlimately by the Promoter. Winners will be notified by email by 26 March, 2010. All prizes will be delivered as soon as they become available. If for any reason a winner does not take an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
- Information Provided
The Promoter will collect personal information about persons who enter this competition so that those persons can participate in the Contest and the Promoter can administer the Contest. The Promoter will disclose that personal information to organisations associated with this Contest. If a competitor does not provide their personal information they cannot participate in the Contest. All entries become the property of the Promoter and, by entering the Contest, unless otherwise advised by the entrant, each entrant consents that the information they submit with their literary piece may be used for promotion or any other purposes by the Promoter. The Promoter is granted a perpetual free licence of copyright in the entries without any further reference or payment or other compensation to the entrant.
- Disclaimer
The Promoter reserves the right to withdraw, amend, suspend or terminate this Contest or disqualify any entrant at any time without prior notice. The Promoter also reserves the right to cancel this Contest at any time because of any error, or if it suspects or finds evidence of tampering with any part of the Contest. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the prize is not available for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize.
- Announcement of Winner
The Promoter respects the privacy of the participants, and therefore information submitted in this Contest will be used solely by itself and will not be disclosed to any outside parties, unless required by law to do so. Subsequently, only the name of the prize winner[s] will only be disclosed on Championship Moves publications.
- Subject to Applicable Laws
This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
